Durable Power of Attorney
At Scotts Valley law firm Dawson, Passafuime, Bowden & Martinez our attorneys are able to prepare Durable Powers of Attorney for people living in Santa Cruz and surrounding counties.
A Durable General Power of Attorney (sometimes called a Financial Power of Attorney) gives a person the authority to make legal and/or financial decisions for someone else. This power may activate immediately or when a person loses the ability to make legal or financial decisions on his/her own but in either case will remain effect during the period of incapacity of the principal.
A Power of Attorney can be drafted to allow someone to do the following on someone else’s behalf:
- Buy or sell real estate
- Invest of money
- Conduct bank transactions
- Pursue legal claims
- Manage property
- Deal with tax and retirement issues
- Make gifts
- Create, amend, modify or revoke trusts
At Dawson, Passafuime, Bowden & Martinez, our Estate Planning Lawyers can give you the legal advice you need about the powers you will be delegating. Our Estate Planning Attorneys can also ensure that the Power of Attorney is properly executed and meets all legal requirements.
